1. Interpretation
1.1 These definitions in clause 1 apply in the terms and conditions set out in this document.
‘Goods” refers to the products that we are selling to you as set out in the Order.
‘Notice of the Right to Cancel” means the cancellation notice set out in the Order.
‘Order” means your order for the Goods as set out overleaf;
‘Terms” means the terms and conditions written in the document;
2. Basis Of Sale
2.1 These Terms and the Order are considered by us to set out the agreement you and Peaky Blinds for the sale of the Goods (”Contract”). Please check that any details on the Terms or the Order are correct. We are that you ask us to confirm any changes in writing by our employees who are authorised. Please ensure that you read and understand these terms before you sign the Order. You will be bound by the Terms once a contract comes in existence between us, in accordance with clause 2.2
2.2 These Terms shall become binding on you and us when we issue you with the Order and you sign your written acceptance of the Order. This also applies as soon as you make contact over the phone. Terms and conditions and quotation will be sent via post or email in the event that you cannot sign a contract.
3. Cancellation of Order.
3.1 A legal binding contract is agreed to when goods are ordered, whether that be by signed order or over the phone deposit confirmation. Our products fall into the category of tailor-made products under the Consumer Contracts Regulations 2013. You will not be able to cancel your order once placed.
4. Interest-Free Options or Finance.
4.1 Payment terms apply to any interest-free option, are under Peaky Blind’s Terms of Contract. A minimum deposit of 10% of the total cost must be paid to Peaky Blinds at the time of placing the order. There must be a minimum spend of £300.
4.2 There will be no refund available on the deposit. The balance will be financed via Peaky Blind’s underwriters. This will then form a legally binding contract between you and Peaky Blinds. There is a cooling period of 14 days, to cancel the finance agreement. You cannot cancel bespoke goods in this period so, if you cancel the finance agreement, you must pay the balance of the order on/before the date of fitting by Bacs Transfer or Cash / Credit Card. These terms must be met. Peaky Blinds is authorised and regulated by the Financial Conduct Authority.
5. Price & Payments
5.1 VAT is included in these prices. If the rate of VAT changes between the date of the Order and the date of delivery, the VAT you pay will be adjusted. This will not be the case if you have already paid for the goods in full before the VAT changes take place.
5.2 A 50% of the Order value is required to be paid on the date of order. Interest-free offers where a 10% minimum deposit is required do not apply to this.
5.3 Deposits are non-refundable. This is due to orders being sent to manufacture as soon as you place your order or sign a contract. If the order for Goods is canceled within terms outlined in 3.1 then the full amount will be refunded. Should your good not be made or no materials/components ordered or cut then your deposit will be refunded in full. Any reasonable costs will be deducted if the order has been started as stated in 3.1.
5.4 Goods will be removed / partially removed until we have received your full payment on the date of installation. Your goods cannot be installed until we receive your payment.
6. Delivery & Out of Stock Items.
6.1 You will be notified when your Goods will be ready. We deliver between ten to fourteen working days of the order being sent out. Peaky Blinds are not liable for any loss you experience if we fail to meet the time scale set out in these terms as this is an estimate only. This includes if we fail to meet that time scale because of circumstances beyond our reasonable control (including, for the avoidance of doubt and without limitation, any loss of income or revenue, loss of business, loss of anticipated savings, loss of data or any waste of time-related to a canceled installation appointment). It will take approximately 14 weeks to Deliver Shutters. It will take up to 18 weeks for Customised Shaped/abnormal Shutter. It is important that you understand that these are approximate dates and are not terms of contact.
6.2 It must be possible for Goods to be installed, without limitation, pets, plants, breakable items, household residents and furniture. We reserve the right to charge you for the costs of the canceled appointment if we are not given 24 hours’ notice.
6.3 We are not responsible for any failure to take delivery, except when this failure is caused by our failure to comply with the terms or when this is beyond our control.
6.4.1 You will be informed by email, phone call or text that your order is ready for delivery. We will hold your order for 14 days after this.
6.5.2 Beyond 14 days, we will have no liability for late delivery. Any damage to goods over a period of time will not be covered by our insurance.
6.6 We may give you reasonable notice in writing that we will deduct storage costs or resell goods if you have not taken delivery of Goods within 14 days.
6.7 We may instruct an external or internal debt collection agency to collect monies due from you if you fail to pay your final balance upon completion of products ordered.
7. Tilt & Turn Window Restrictions / Blackout Property Goods
7.1 There will be opening restrictions when Goods are fitted to Tilt and Turn Windows. This applies to Fire Escape Windows and should be treated as such. We are not responsible for restricting any windows in which we install Goods. It is your responsibility that you adhere to fire safety laws in your home.
8. Defective Goods and Returns
8.1 You must let us know within three days of the date of delivery if Goods do not conform with Terms and Conditions. We will reply within 24 hours of when you email two photos of the defect or damage.
8.2 If we need to collect Goods on a date agreed between us, we will check that the Goods are faulty. We will then:
work to repair goods as a priority
replace the Goods if needed
refund you in full or partially
8.3 There is a warranty period of one year on Goods. Any repair callouts will be charged at £22.50
If parts are needed to repair Goods, only the cost of the parts will be charged. We are always on hand to receive calls if you need assistance. Customer care is our priority.
9. Safety Devices
9.1 You will be in breach of government regulations and laws if you remove any safety devices.
10. Obstructions
10.1 You must inform us immediately about any plasterwork, tiling or joinery that might affect the size of the Goods ordered. If you do not, you will be liable for any charge required to alter the size of the goods. We are not liable for any costs due to small fractures to tiling or costs due to poor fixtures or plasterwork.
